OIC Fiqh Academy to discuss rights, duties of non-Muslims in Islamic countries: IINA Report

Jeddah (IINA) – Representatives of the 57 member states of the International Islamic Fiqh Academy of the Organization of Islamic Cooperation (OIC) will hold the Academy’s 22nd session in Kuwait on March 22-25.

During the session, they will discuss issues related to the rights and obligations of non-Muslim citizens in the Islamic countries, women and general authority (Al-Wilayah Al-Ammah), visiting Jerusalem, takfir and jihad, as well as economic issues and other topics relating to the Islamic rulings on halal foods and medicines, and the rights of persons with disabilities.

In a statement to the International Islamic News Agency (IINA) on Tuesday, Secretary General of the Islamic Fiqh Academy Dr. Ahmed Khalid Babiker said, "The Academy will define in its forthcoming session the rights and obligations of non-Muslim citizens in Islamic countries, and to what extent Sharia law is applied to them in response to the extremists ideology and those who do not know the rights of these citizens”

Dr. Babiker explained that “Islam calls for respect for non-Muslims, and urged Muslims to deal with them in the best manners and to keep charity and goodly ways in their relation with them". He added that "Islam also calls Muslims to deal justly with non-Muslims, as long as their status does not disturb the people."

For his part, Dr. Ahmed Abdel Aleem Abualio, director of the Department of Research and Studies at the Academy, told IINA that “the Academy will discuss the issue of offensive Jihad (Jihad Al-Talab) and defensive Jihad (Jihad Al-Defaa), in order to respond, pursuant to the fatwa that will be issued, to those who use the term ‘jihad’, without having the slightest understanding of its rules, definitions and objectives, for the sake of killing and bloodshed. He noted that the fatwa will explain the meaning of jihad, and who has the power to declare jihad, as well as the relevant rules, so that the people can understand the true meaning of jihad”.

Abualio added that the fatwa to be issued by the Academy will also explain the ruling on declaring takfîr against a Muslim, and its effects on the community,” pointing out that “the Academy has already issued a resolution in which it stressed that it is unlawful to declare takfir against someone who utters the shahadatain or the two testimonies”.

He said that the Islamic ruling on visiting Jerusalem and Al-Aqsa Mosque is among the key topics to be reviewed by the Academy members during the session. The visit will be discussed in terms of its objectives, effects and Islamic rulings. The members will also discuss the Islamic ruling on democracy and the extent of the possibility to take advantage of this system, along with the inherent Islamic principle of Shura.

With regards to economic issues, Abualio said the Academy will review the bank guarantee of the risks arising from the misuse of client's investment funds and compensation for the damage caused.

The Academy is slated to review the recommendations of the two scientific seminars, held previously by the Academy on some economic topics relating to Takaful and financial transactions.

It will also discuss the recommendations of the two scientific seminars, held in Jeddah last February, on the issues of "Conversion and Consumption” and response to the inquires made by the OIC’s Standards and Metrology Institute for Islamic Countries (SMIIC) about the Islamic ruling on halal food and drug.

It will further review a report, on the "controls and rulings of slaughtering after electric stunning", prepared by the committee of scholars and vets, who had visited some of the meat production companies, pursuant to a decision made by the Academy in its 21st session in the Saudi capital Riyadh.
